1. Introduction

Welcome to Elite Business Coaching. These Terms of Service ("Terms") govern your use of our website, products, and services. By accessing our website or using our services, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you ("Client", "you", or "your") and Elite Business Coaching ("Company", "we", "us", or "our").

2. Service Description

Elite Business Coaching provides business coaching, consulting, and advisory services to individuals and organizations. Our services may include, but are not limited to, one-on-one coaching, group coaching, workshops, seminars, digital content, and training materials.

We reserve the right to modify, suspend, or discontinue any part of our services at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of our services.

3. Client Responsibilities

As a client, you acknowledge that coaching results depend on your commitment and active participation. You agree to:

• Provide accurate and complete information as requested
• Actively participate in scheduled sessions and complete agreed-upon tasks
• Communicate openly and honestly with your coach
• Make payments on time according to the agreed payment schedule
• Respect the intellectual property rights of the Company
• Use the services in compliance with all applicable laws and regulations

4. Payment and Refunds

All fees for our services are due in advance unless otherwise specified in your coaching agreement. Payments can be made via the methods specified on our website or in your coaching contract.

Our refund policy varies by service type:

• One-time services: Cancellations made more than 48 hours before the scheduled service may receive a full refund. Cancellations made less than 48 hours before the service may incur a cancellation fee of up to 50% of the service fee.
• Coaching packages: Refunds for unused sessions may be available on a prorated basis, less a 15% administrative fee, at our discretion.
• Digital products: Due to their nature, digital products are generally non-refundable once access has been granted.

Refund requests must be submitted in writing to connect@elitecoach.in and will be evaluated on a case-by-case basis.

5. Intellectual Property

All content provided by Elite Business Coaching, including but not limited to text, graphics, logos, images, audio, video, and software, is the property of the Company or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of our services or content without our express written permission. Any unauthorized use terminates the permission granted to you by these Terms.

Materials provided to you during coaching sessions are for your personal use only and may not be shared with third parties without our express written consent.

6. Confidentiality

We respect the confidentiality of our client relationships. Information shared during coaching sessions will be kept confidential except in the following circumstances:

• When disclosure is required by law
• When there is a clear and imminent danger to yourself or others
• When you provide written permission to share information

We may use anonymized client experiences and results for educational and marketing purposes without disclosing identifying information.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Elite Business Coaching, its directors, employees, partners, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our services
• Any unauthorized access to or use of our servers and any personal information stored therein
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, or the like that may be transmitted to or through our services by any third party

Our total liability for any claims under these Terms shall not exceed the amount you paid to us for the services that are the subject of the claim.

8. Disclaimer of Warranties

Your use of our services is at your sole risk. Our services are provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that our services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. The results obtained from the use of our services may vary and are dependent on various factors including your commitment, implementation, and market conditions.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use our services.
